Co-signer & collateral
Who Can Post Bail for Someone Else?
You do not have to be family. But there are two situations where the person willing to pay is exactly the wrong person to do it.
The short answer: you do not need to be related. Anyone of legal age can generally post cash bail or act as a co-signer, subject to the surety accepting them. The longer answer is about the two situations where the willing payer is the wrong payer.
What a co-signer actually takes on
The person who signs is the indemnitor, and they promise the surety that if the defendant does not appear and the bond is forfeited, they will make the surety whole — for the full bail amount, not the premium. That is a real financial obligation, and it does not depend on any relationship to the defendant. See co-signer responsibilities, does the co-signer go to court and removing a co-signer.
Exception 1 — a protective order is in place
This comes up constantly in domestic violence cases, and it deserves a plain warning. A protective order binds the restrained person regardless of who posts the bail. If the protected person pays for the release, the order still prohibits contact, and contact initiated by the protected person does not authorise the restrained person to respond. Breaching it is a fresh offence — see violating a court order and protective orders and EPOs.
Only the issuing court can change an order. If you are the protected person and you want the order modified, that is a court application, not something achieved by paying a bond. Speak to a lawyer first.
Exception 2 — where the money came from
Penal Code 1275.1 allows a court to decline to accept bail where there is reason to believe the funds were feloniously obtained, until their legitimate source is shown. This arises more often in financial and alleged-sales cases. Keep documentation of where the money came from — see PC 1275 holds.
What posting bail does not buy
- Control. Paying does not give you authority over the defendant’s decisions, their lawyer, or the case.
- Information. A lawyer’s duty runs to the client, not to whoever paid.
- A refund. The premium is the cost of the service and is not returned — see cash bail vs a bail bond.
If you are considering paying for someone whose appearance you are not confident about, read bond surrender and PC 1305 forfeiture before signing, not after.
