The Sheriff records that “on January 1, 2000, Rancho Santa Margarita became the 33rd city in Orange County”, gives its population as approximately 49,704 across roughly 15 square miles, and describes a master-planned city set against the foothills of the Santa Ana Mountains with more than 1,700 acres of dedicated open space and a 13-acre community lake.

Two things about that setting shape the calls we take from here.

It is the far edge of the county

Rancho Santa Margarita sits at the inland eastern edge of the county, and the places that matter after an arrest are all somewhere else. The Intake Release Center in Santa Ana and the Harbor Justice Center in Newport Beach are both a substantial drive, in different directions.

That is precisely why doing this by phone and electronic signature matters more here than in most places. There is rarely any reason for a family to make that drive twice, and no reason to make it at all before we have confirmed which facility actually holds the person.

There is a Police Services counter — but it does not take bail

This city is unusual among the sheriff-policed ones in publishing a clear account of what its front counter actually does. Across its published Police Services questions the City describes the counter signing off proof of correction citations at City Hall, Monday through Friday, 8 a.m. to 5 p.m., running free vacation home checks, and taking welfare-check requests through dispatch. It also states plainly what the counter cannot do: LiveScan fingerprinting is not available there, and is instead done by appointment at the Sheriff’s Lake Forest station, 20202 Windrow, where the Investigations Division is based on (949) 206-6100.

Bail is not among the counter’s published functions, and neither the City nor the Sheriff describes any jail, holding or booking facility in the city. That distinction is worth drawing rather than assuming: a counter that signs off citations is not a counter that takes a bond.

Who makes the arrest in Rancho Santa Margarita

Rancho Santa Margarita contracts its law enforcement to the Orange County Sheriff’s Department.

The City puts it without qualification: it “contracts with the Orange County Sheriff’s Department for all of its law enforcement needs.” The Sheriff uses almost the same words. Mission Viejo, Lake Forest and San Juan Capistrano are policed the same way; further north, so are Stanton, Villa Park and Yorba Linda.

• The Sheriff also notes that “a direct phone line to Sheriff’s Dispatch is… located outside the City Hall Lobby Entrance” — useful if you are already there and the counter is shut

Where an arrested person is held is a county matter from that point. The Sheriff publishes no fixed sequence and no timings, so confirm the actual location rather than assuming one.

Where a bond can actually be posted for a Rancho Santa Margarita arrest

Nowhere in the city, and nowhere nearby. Under Penal Code section 1269b the officer in charge of the jail holding a person is among those authorised to approve and accept bail, and the Sheriff lists only two places where that happens:

• Intake Release Center — 550 N. Flower Street, Santa Ana. Bonds accepted 24 hours a day. (714) 647-6085.
• Theo Lacy Facility — 501 The City Drive South, Orange. Bonds accepted daily 8:00 a.m. to 2:00 p.m. (714) 935-6905.
• Bonds are not accepted at the James A. Musick Facility in Irvine — the county jail closest to this side of the county, and therefore the one families set off for by mistake.

The Sheriff lists accepted payment as cash, bank cashier’s cheques, personal cheques presented with two forms of identification, money orders and traveller’s cheques, and cash only for a case in any court outside Orange County. How to find someone after a Rancho Santa Margarita arrest

Use the county inmate search before you drive anywhere. How bail is set

Under Penal Code section 1269b, the superior court judges of each county must adopt and annually revise a uniform countywide bail schedule, and the officer in charge of the jail where a person is held is among those authorised to approve and accept bail. In practice the amount is frequently fixed before anyone appears in front of a judge. Because that authority sits with the facility rather than the court, posting on the schedule does not require waiting for a first appearance. We cannot promise how long any release takes.

Everything is an hour away. Do we have to drive there?

Usually not, and certainly not before we have confirmed where the person is. Paperwork can be completed and signed electronically, and the posting happens at whichever facility holds them. An agent can meet you at the jail or the court if you do need to attend.
