Charges
Conspiracy (Penal Code 182)
An agreement plus one act — and a charge punished as though the planned offence had been carried out.
Conspiracy surprises people because it does not require the planned crime to have happened. An agreement, plus one overt act by any participant, is enough to charge it — and it is generally punished as though the target offence had been completed.
What Penal Code 182 requires
- An agreement between two or more people to commit a crime.
- An overt act by one of them in furtherance of that agreement. The overt act does not itself need to be criminal — buying something ordinary can qualify if it furthers the plan.
Conspiracy to commit a felony is ordinarily punished in the same manner and to the same extent as the felony that was its object. That is the single most important fact for bail: the figure is generally priced against the target offence, not against “a conspiracy” in the abstract.
Why the totals get large fast
| Priced as the target offence | A conspiracy alleging a serious felony carries that felony’s schedule figure. |
| Multiple defendants | Several people can be charged on the same alleged agreement, each with their own bail. |
| Counts stack | Several target offences means several counts on the schedule. |
| Enhancements | Weapon or great bodily injury allegations add on top — see enhancements. |
| Source of funds | In financial cases a court may examine where the bail money came from under Penal Code 1275.1 — see PC 1275 holds. |
Related charges
Where the allegation is help given after the offence rather than agreement before it, the charge is accessory after the fact under PC 32. Financial conspiracies commonly travel with fraud and forgery and identity theft; property cases with burglary and receiving stolen property.
What matters in the first hours
Multi-defendant cases move quickly and the recorded jail line is a real hazard — co-defendants discussing a case on a monitored call is exactly the evidence these prosecutions are built on. See inmate phone calls, and get a criminal defence lawyer involved immediately.
Working out the amount, and what can change it
The figure comes from the countywide schedule Penal Code 1269b requires each county’s judges to adopt and revise annually. A judge may raise bail under 1269c, a hearing may be required in serious cases under 1270.1, and under In re Humphrey (2021) 11 Cal.5th 135 a court must consider ability to pay before setting money bail that results in detention.
