Mission Viejo is a Sheriff’s contract city

Mission Viejo contracts its law enforcement to the Orange County Sheriff’s Department. It is one of thirteen Orange County cities that do so — and notably, most of south Orange County works this way: Aliso Viejo, Dana Point, Laguna Hills, Laguna Niguel, Laguna Woods, Lake Forest, Mission Viejo, Rancho Santa Margarita, San Clemente and San Juan Capistrano are all sheriff-policed, as are Stanton, Villa Park and Yorba Linda further north.

That has a direct consequence after an arrest. There is no municipal jail in Mission Viejo. Deputies handle the arrest from the outset, which usually means a more direct route into the county system — typically the Orange County Intake Release Center at 550 N. Flower Street in Santa Ana, with longer-term housing at the James A. Musick Facility in Irvine or Theo Lacy in Orange.

Say it is a Mission Viejo arrest when you call. It tells us to go straight to the county system rather than working through city facilities that would not have the person.

How bail is set

Under Penal Code section 1269b, the superior court judges of each county must adopt and annually revise a uniform countywide bail schedule, and the officer in charge of the jail where a person is held is among those authorised to approve and accept bail. In practice the amount is frequently fixed before anyone appears in front of a judge.
