Diversion: When a Case Can End Without a Conviction
Several California programmes can resolve a case without a conviction. They are worth asking about early — before money goes anywhere else.
Families spend the first night thinking about release and the money. The question that often matters more arrives a week later: can this case end without a conviction at all? California has several statutory routes that can do exactly that.
The main statutory routes
| PC 1000 — drug diversion | A deferred-entry style route for qualifying drug offences. See possession vs possession for sale and HS 11550, where this most often arises. |
| PC 1001.36 — mental health diversion | A route for defendants with a qualifying diagnosis, subject to statutory eligibility criteria and the court’s discretion. Distinct from PC 1368 competency, which is about fitness to stand trial. |
| PC 1001.80 — military diversion | For current or former members of the United States military affected by conditions arising from service, for qualifying misdemeanour offences. |
Eligibility rules, exclusions and the court’s discretion all matter, and they change. We are not going to tell you whether you qualify — that is a lawyer’s assessment, and getting it wrong in either direction is costly.
Why we are raising it on a bail site
Because of how people spend money. A family with limited funds will often commit everything to a premium and then have nothing left for a lawyer. If a case might resolve through diversion, the lawyer is the person who makes that happen — and appointed counsel may be available at no cost or reduced cost under Penal Code 987. See how to get a public defender.
So the honest ordering is: get them out if the amount is manageable, then get a lawyer and ask about diversion early. If the amount is not manageable, talk to a lawyer before committing everything — see bail reduction hearings.
What diversion does not do
- It does not change tonight’s bail figure, which comes from the charge as booked on the county schedule.
- It does not release anyone. It is about how the case resolves, not about custody.
- It is not automatic. It is applied for, and the court decides.
- It does not remove a protective order. Only the issuing court can do that — see conditions of release.
