Driving on a Suspended License (Vehicle Code 14601)

One of the highest-volume arrests in both counties — and the one where the underlying warrant, not the driving, is usually what keeps someone in custody.

This is one of the most common arrests in Orange and Los Angeles County, and one of the most commonly misunderstood. The driving offence itself rarely keeps anyone in custody. The warrant it uncovers usually does.

What the section covers

Vehicle Code 14601 and its subdivisions make it an offence to drive when the driving privilege is suspended or revoked, where the driver knew of the suspension. The subdivisions matter because they are treated differently:

14601.1 The general provision — driving while suspended or revoked for a reason not otherwise specified.
14601.2 Driving while suspended for a DUI. Treated substantially more seriously, and carries mandatory minimum custody on conviction.
14601.5 Suspension arising from a chemical test refusal or a per-se administrative action.

These are misdemeanours, not felonies. A separate provision, Vehicle Code 12500, covers driving without ever having been licensed, which is a different thing again.

Why most of these never need a bond

For a misdemeanour, California’s default is release rather than custody. Penal Code 853.6 provides that a person arrested for a misdemeanour who does not demand to be taken before a magistrate shall be released on a written notice to appear. In practice most suspended-licence stops end with a citation and a tow, not a booking. See cite and release.

What turns it into a night in custody

  • An outstanding warrant. Overwhelmingly the most common reason. A licence suspension frequently traces back to an unpaid or missed matter, and that matter often carries a bench warrant — which does not expire. The warrant carries its own bail amount, and Penal Code 1269b(g) provides that posting bail discharges a person only as to the offence it was posted on. See failure to appear and warrants.
  • A 14601.2 DUI-related suspension, treated far more seriously than the general provision.
  • Another charge arising from the same stop — most often DUI.
  • One of the other PC 853.6(i) exceptions: intoxication, inability to establish identity, or refusal to sign the notice.

The car is a separate and growing problem

A vehicle driven by an unlicensed or suspended driver is frequently towed, and in some circumstances held for an extended period. Storage fees accrue daily and routinely exceed what people expect. That cost is separate from bail and is not handled at the jail — see getting property back. Deal with it early, especially over a weekend.

If there is a warrant and no arrest yet

Many people discover a suspension and a warrant before being stopped. That is the better position to be in, because the bond can be arranged in advance of surrendering rather than from inside a cell — see walk-through bail, and speak to a criminal defence lawyer first, since a warrant can sometimes be recalled without custody at all.

Working out the amount, and what can change it

The figure comes from the countywide schedule that Penal Code 1269b requires each county’s judges to adopt and revise annually — which is why Orange and Los Angeles County can attach different numbers to identical conduct. A judge may raise bail under Penal Code 1269c, a hearing may be required before release in serious cases under 1270.1, and under In re Humphrey (2021) 11 Cal.5th 135 a court must consider ability to pay before setting money bail that results in detention.

The process around it

Where they are, and where the case is heard

Which facility is holding the person decides how much time you actually have — a Temporary Holding facility must move someone within 24 hours, while a Type I city jail may hold an adult up to 96 hours excluding holidays. See what the classifications mean, then our Orange County and Los Angeles County jail guides, and find an inmate.

Neither county’s Superior Court publishes a public city-by-city table assigning criminal cases to courthouses. The release paperwork names the courthouse, date and time, and it governs — see understanding your release paperwork and all courthouses.

Please note: American Freedom Bail Bonds is a licensed bail bond agency, not a law firm. Nothing on this page is legal advice, and we cannot predict how any case will be charged or resolved. Charging decisions are made by the prosecutor, not by the arresting agency, and bail schedules are revised annually. Always confirm current details with the facility, the court, or a criminal defence lawyer. California bail license 1841014.

When the suspension came from a DUI (VC 14601.2)

This is the subdivision that changes everything. Driving while the licence is suspended or revoked because of a DUI is treated substantially more seriously than the general provision, and a conviction carries mandatory minimum custody. It is also the version most likely to arrive with a probation hold, because the person is often still on probation for the underlying DUI — see DUI with priors, DUI test refusal and holds and multiple cases.
