How Enhancements Change a Bail Amount

Why the bail figure is often far higher than the charge alone would suggest — enhancements stack on top of the schedule, and they stack fast.

A family looks up the charge, finds the schedule figure, and then hears a number several times larger. Almost always the explanation is the same: enhancements. They are allegations attached to a charge, and on a bail schedule they generally add to the base figure rather than replacing it.

What an enhancement is

An enhancement is not a separate crime. It is an allegation about how the offence was committed or who committed it, attached to the underlying charge. The Penal Code 12022 series is the group most often seen at the bail stage:

PC 12022(a)(1) Being armed with a firearm in the commission of a felony.
PC 12022.5 Personal use of a firearm in the commission of a felony.
PC 12022.53 The provision commonly called “10-20-life”, applying to specified serious felonies where a firearm is used or discharged.
PC 12022.7 Personally inflicting great bodily injury in the commission of a felony.

Why the arithmetic surprises people

Three things compound at once, and each is independently unremarkable:

  1. Counts stack. Several charges each carry their own scheduled figure.
  2. Enhancements add. Each alleged enhancement adds its own amount on top.
  3. The schedule prices the allegation, not the proof. Bail is computed from what is recorded at booking. Nobody at that stage is assessing whether the enhancement will survive, or be filed at all.

That last point is the one worth holding on to. An enhancement alleged at booking may never be filed by the prosecutor — but the bail figure tonight reflects it. See how bail schedules work and the Orange County schedule, which sets out the top-term rule for unlisted felonies.

Strike allegations are a different and larger problem

Where the underlying offence is a serious felony under Penal Code 1192.7(c) or a violent felony under 667.5(c), the consequences extend well beyond the bail figure. Many enhancement allegations, particularly firearm and great bodily injury allegations, are precisely what brings an offence within those definitions. See three strikes and bail.

These are also the cases where Penal Code 1270.1 requires a hearing before release rather than release on the schedule amount, and where a court may increase bail under 1269c. See when bail can be denied.

What can actually be done about the number

Not much at the counter — but a court can revisit it. A bail reduction hearing is the mechanism, and under In re Humphrey (2021) 11 Cal.5th 135 a court must consider ability to pay before setting money bail at an amount resulting in detention. That is a matter for a criminal defence lawyer, not for a bail agent.

Working out the amount, and what can change it

The figure comes from the countywide schedule that Penal Code 1269b requires each county’s judges to adopt and revise annually — which is why Orange and Los Angeles County can attach different numbers to identical conduct. A judge may raise bail under Penal Code 1269c, a hearing may be required before release in serious cases under 1270.1, and under In re Humphrey (2021) 11 Cal.5th 135 a court must consider ability to pay before setting money bail that results in detention.

The process around it

Where they are, and where the case is heard

Which facility is holding the person decides how much time you actually have — a Temporary Holding facility must move someone within 24 hours, while a Type I city jail may hold an adult up to 96 hours excluding holidays. See what the classifications mean, then our Orange County and Los Angeles County jail guides, and find an inmate.

Neither county’s Superior Court publishes a public city-by-city table assigning criminal cases to courthouses. The release paperwork names the courthouse, date and time, and it governs — see understanding your release paperwork and all courthouses.
