Bail process

Posting Bail in California From Out of State

You do not need to fly in. A California bond can be arranged, signed and paid remotely — but an out-of-state warrant, a hold, or a time zone can still cost you a court cycle.

You are in another state. Someone you care about has been arrested in Orange County or Los Angeles County, and you are trying to work out whether you have to get on a plane. In almost every case you do not. A California bail bond can be arranged and signed remotely, and the money moves without you being here.

The short answer

A bail bond in California is written by a California-licensed bail agent against a California court’s bail amount. Your location does not change that. What you provide as a co-signer — identification, information, a signature, payment — can all be provided from another state. The defendant is released in California; you never have to be.

What you cannot do is post a bond from your own state’s bail company. A bond is a contract with a surety admitted in the state where the case sits. An agent in Texas or Nevada cannot post a bond at the Orange County Intake Release Center. They can refer you; they cannot write it.

What we need from you, wherever you are

Who and where The defendant’s full name, date of birth, and which facility is holding them. If you are not sure, start with finding an inmate.
The charge and the amount The booking charge drives the schedule amount. See how bail schedules work.
Your identification A government-issued photo ID. An out-of-state licence is fine.
Co-signer information Employment and residence details, and an understanding of what you are taking on — see co-signer responsibilities.
Signature Executed remotely. See our forms for what the paperwork looks like before you commit to anything.

The time zone is the part people get wrong

California is Pacific time, and custody runs on the facility’s clock, not yours. If you are on the East Coast, a 9pm arrest in Anaheim is midnight where you are, and the overnight hours are when a release is most easily accomplished. Waiting until your morning can cost a full court cycle. We answer the phone at every hour for exactly this reason.

The other timing trap is the weekend. An arrest late on a Friday can mean the first court appearance does not happen until Monday or Tuesday — see arrested on a weekend and arraignment, where the Penal Code 825 clock excludes Sundays and holidays.

When the case is in California but the person lives elsewhere

This is the reverse situation, and it is more complicated than it looks. A defendant who lives out of state but has a California case still has to appear in a California court. The bond secures that appearance. Two things follow:

  • Travel is a condition in practice, not an inconvenience. Missing a California date because of distance still produces a bench warrant — see failure to appear.
  • Tell the agent up front. A defendant with no California ties is a different underwriting question. It is far better to say so at the start than to have it emerge later.

An out-of-state warrant is a separate problem

If the person was arrested in California on a warrant from another state, a California bail bond generally will not release them. They are being held for the demanding state, and that is an extradition question governed by that hold rather than by a California bail amount. The same logic applies to a hold from another California county — see out-of-county warrants. Establish whether a hold exists before paying anyone, because a bond posted against the California charge will not open the door while the hold stands.

Before you send money to anyone, from anywhere

Distance is exactly the condition bail scams are built for: you cannot walk into an office, you are frightened, and you are in a hurry. California bail agents are licensed by the Department of Insurance and the licence can be checked free, by anyone, in about a minute. Ours is 1841014.
