Court procedure
When Criminal Proceedings Are Suspended: Competency (PC 1368)
If a doubt is declared about a defendant’s mental competence, the criminal case stops — and the usual bail questions stop with it.
This is one of the situations where a bail agent should hand the question over rather than try to answer it. If a court declares a doubt about a defendant’s mental competence, the criminal proceedings are suspended — and the ordinary rhythm of charges, hearings and bail motions pauses with them.
What Penal Code 1368 does
Penal Code 1368 addresses the situation where a doubt arises about whether a defendant is mentally competent to stand trial. Broadly, competence concerns whether the person is able to understand the nature of the proceedings and to assist counsel in a rational manner. If the court declares a doubt, the criminal proceedings are suspended until the question is determined.
Two things this is not: it is not a finding about guilt, and it is not a dismissal. It is a pause while a specific question is answered.
What it means for the family
- The case will not progress on the usual timetable. Expect dates to move — see when the court date changes.
- Custody questions still belong to the court, but the ordinary route of bail motions is affected because the proceedings themselves are suspended.
- A lawyer is essential. This is squarely legal territory and appointed counsel may be available — see how to get a public defender.
- A co-signer’s obligation continues until the bond is exonerated, and a suspended case can run long — see co-signer responsibilities and bail exoneration.
How this differs from the other mental health situations
| PC 1368 competency | Inside a criminal case. Concerns fitness to stand trial. Proceedings are suspended. |
| WIC 5150 hold | A civil mental health detention, up to 72 hours. A bail bond does not end it — see mental health holds. |
| Mental health diversion | A separate statutory route that can affect how a case resolves — see diversion programs. |
What we can and cannot do
We can tell you whether a bail amount exists, whether a hold appears to be in place, and where the person is held. We cannot advise on competence, predict how long a determination takes, or explain what a particular evaluation means. Those are questions for the defence lawyer, and in this area the lawyer matters far more than the bond.
