San Clemente is the southernmost city in Orange County. Its southern boundary is the San Diego County line at Camp Pendleton — and that single fact causes more confusion on San Clemente calls than anything else.

An arrest a few miles down the 5 is a San Diego County matter: a different sheriff, a different jail system, a different courthouse, and a separate countywide bail schedule. Families routinely call the wrong county and are told there is no record of the person.

Who makes the arrest in San Clemente

San Clemente contracts its law enforcement to the Orange County Sheriff’s Department.

It is one of thirteen Orange County cities with no municipal police force of their own — alongside Aliso Viejo, Dana Point, Laguna Hills, Laguna Niguel, Laguna Woods, Lake Forest, Mission Viejo, Rancho Santa Margarita, San Clemente, San Juan Capistrano, Stanton, Villa Park and Yorba Linda.

That changes the first few hours. There is no city jail to hold someone in while booking is sorted out. Deputies handle the arrest from the outset, which usually means a more direct route into the county system — typically the Orange County Intake Release Center at 550 N. Flower Street in Santa Ana, with longer-term housing at the James A. Musick Facility in Irvine or Theo Lacy in Orange.

So for an Orange County arrest, start with the county system in Santa Ana. For an arrest south of the line, none of that applies.

How bail is set

Under Penal Code section 1269b, the superior court judges of each county must adopt and annually revise a uniform countywide bail schedule, and the officer in charge of the jail where a person is held is among those authorised to approve and accept bail. In practice the amount is frequently fixed before anyone appears in front of a judge, which is why posting on the schedule is often the fastest lawful route out.

Note the word countywide. Orange County and San Diego County maintain entirely separate schedules, so the same conduct can carry a different scheduled amount depending on which side of the boundary it happened.

Which agency made the arrest decides it. Orange County Sheriff’s deputies means an Orange County case, heard at the Harbor Justice Center in Newport Beach. An agency south of the line means San Diego County, with its own courts, jails and bail schedule. Tell us where it happened as precisely as you can.

Does the bail amount change between counties?

It can. Penal Code section 1269b requires each county’s judges to adopt their own uniform countywide schedule, and Orange and San Diego counties set theirs separately.

Why is there no San Clemente police station holding him?

Because the city contracts policing to the Orange County Sheriff and has no municipal jail. The route usually runs straight into county custody at the Intake Release Center in Santa Ana.

You are in north county. Is that a problem?

Less than it looks. Sheriff-policed south county arrests are generally booked north in Santa Ana anyway, and the paperwork is electronic.
