Warrant Recall: Clearing a Bench Warrant in Orange or LA County

A bench warrant does not expire. But it can often be recalled — sometimes without anyone spending a night in custody. Here is how that fits with bail.

A bench warrant issued for a missed court date stays active until it is served or recalled — there is no expiry. The good news, which most people never hear: a warrant can often be recalled by the court, and when that happens there may be no arrest, no booking and no new bond at all.

What “recall” means

To recall a warrant is for the court that issued it to withdraw it, usually by putting the case back on calendar. People also say “quash”, which is used loosely for the same idea. Either way, the decision belongs to the court — not to the police, the jail or a bail agent.

How it usually happens

  • Through a criminal defence lawyer. A lawyer can ask the court to recall the warrant and set a new date. In many cases the defendant appears alongside the lawyer and the warrant is recalled in the courtroom.
  • By the defendant appearing voluntarily. Some courts permit this. The risk is that the court may instead remand the person into custody, so appearing without a lawyer is a gamble.
  • By surrender with a bond ready. Where custody is likely, the bond can be arranged first so release follows quickly — see walk-through bail.

Practice varies by courthouse and by judge. We will not guess at a particular court’s procedure; a lawyer who appears there regularly will know it.

Where there was already a bail bond

If the warrant issued because a bailed defendant missed court, the bond was forfeited at the same time. Penal Code 1305 then gives a statutory period — generally 180 days, plus time for mailing notice — during which the court can vacate the forfeiture if the defendant appears or the absence is excused. Acting quickly protects the co-signer from liability for the full bail amount. See PC 1305 bail forfeiture and failure to appear.

Call the agent who wrote the bond as soon as you know. It is in everyone’s interest to get the defendant back before the court.
