How to Post Bail in Santa Ana

Santa Ana is the county seat, and the city where Orange County’s main custody and court buildings sit — but the city police facility is only a Temporary Holding facility, limited to 24 hours or less. The county Intake Release Center is a short distance away, and that is where most of this actually happens.

Step 1 — Establish where they are, and how long they can stay there

The Board of State and Community Corrections classifies the Santa Ana Police Facility (facility 3765) as TH. Under Title 15 § 1006 a Temporary Holding facility may hold an adult 24 hours or less, pending release, transfer or a court appearance. That is a quarter of the window a Type I city jail such as Fullerton has, so the useful work happens fast and largely by phone — and the person may already have moved by the time you call. Step 2 — Booking has to finish first

Nobody appears in any inmate search and no bond can be posted until booking completes. An empty search result almost always means booking is still running. Step 3 — Get the exact charge, because the charge sets the amount

No officer decides a bail figure. It comes from the countywide schedule Penal Code 1269b requires the judges of each county to adopt and revise annually. A subdivision, an enhancement or an extra count moves the number materially.

Step 4 — Check for anything that stops a release

The step people skip, and the most expensive one to skip. Penal Code 1269b(g) provides that posting bail discharges a person only as to the offence it was posted on — so an old warrant or a hold leaves them in custody after the money is committed. Step 5 — Cash bail, or a bond

Cash bail ties up the full amount and comes back at the end of the case if the person appears. A bond costs a premium that does not. Step 6 — Release, then the court date

Once posted, release is a processing question rather than a money question — see how long release takes and after posting bail. Arraignment must generally happen within 48 hours, excluding Sundays and holidays, under Penal Code 825 — see arraignment and arrested on a weekend.

Where a Santa Ana case is heard

The Superior Court lists Central Justice Center as handling traffic, minor offenses, criminal, unlimited civil, limited civil and small claims. That describes what that courthouse handles — it is not a case assignment.
