Injured at Arrest: Medical Clearance, Hospital Transfers and Bail

A person who needs treatment is still in custody — but the sequence changes, and posting bail early can buy nothing.

When someone is hurt at the time of arrest — a collision, a fight, a fall, or simply a pre-existing condition — the ordinary sequence changes. Treatment comes before booking, and until booking happens there is no record, no searchable entry, and often nothing useful a bond can do yet.

Medical clearance comes first

A custody facility may require a person to be medically cleared before it will accept them into booking. That can mean a trip to hospital, an examination, or treatment. It happens before the booking process begins, which explains something families find frightening: the person is definitely in custody, and yet nothing comes up in any search. See arrested but not showing in the inmate search.

Hospitalised under guard

A person receiving treatment under guard is still in custody. The case exists, a bail amount may exist, and the Penal Code 825 arraignment clock continues to run — generally 48 hours, excluding Sundays and holidays. What does not work is treating the hospital as the place to arrange a release: that runs through the custody facility.

Why posting early usually buys nothing

This is the honest advice, and it costs us money to give it. If the person has not been booked, a posted bond generally cannot produce a release — there is nothing to release them from yet in the administrative sense. Confirm with the facility that they are booked and bail-eligible before paying anyone. See how long release takes.

How this differs from a mental health hold

Medical clearance / treatment About physical health. Delays booking and release, but is not itself a legal hold.
5150 mental health hold A civil detention under Welfare and Institutions Code 5150, up to 72 hours. A bail bond does not end it — see mental health holds.
Probation or parole hold Keeps the person in custody regardless of any bond — see holds and multiple cases.

If the injury is part of the allegation

Where injuries are alleged to have been caused by the arrested person, the charge and the bail figure change substantially — see DUI causing injury, assault and battery and how enhancements change bail, since great bodily injury allegations add to the scheduled figure rather than replacing it.

What families can usefully do

  • Ask the facility whether the person is booked, and whether they are bail-eligible.
  • Ask whether medical clearance is still outstanding.
  • Do not rely on the inmate search during this period — it will not show them.
  • Get a criminal defence lawyer involved if injuries are part of the allegation.
