Booking & release

When Identification Is the Problem

Not having ID is one of the few things that reliably turns a citation into a booking — and it causes a second delay on the way out.

Identification sounds like a detail. In the bail process it is a bottleneck at both ends: it can be the reason someone was booked instead of cited, and it can be the reason a release or a property collection stalls hours later.

At the roadside: why no ID often means custody

For a misdemeanour, California’s default is release on a written notice to appear under Penal Code 853.6. But the statute lists exceptions, and one of them is that the person could not provide satisfactory evidence of personal identification. Release on a promise to appear depends on the officer knowing who is promising.

So a stop that would have ended in a citation can end in a booking purely because nothing could establish who the person was. See cite and release.

The thing that makes it far worse

Giving a false name is its own offence under Penal Code 148.9 — and it does not work, because identity is generally established by fingerprints during booking regardless. The usual motive, avoiding an existing warrant, backfires for the same reason. See giving false identification to police.

At booking: identity and the clock

Establishing identity is part of booking, and nothing moves until booking completes — the person does not appear in any inmate search and no bond can be posted. Where identity is genuinely difficult to establish, that process takes longer, which is one of the quieter reasons a release stalls. See how long release takes.

On the way out: the circular problem

Property windows generally require photo identification — which is awkward when the wallet is inside the property being collected. Facilities handle this in different ways. Ask what they accept before making the trip, and see getting property back.

If you are the one posting bail

A co-signer is normally asked for government-issued photo identification. An out-of-state licence is usually fine — see posting bail from out of state and what to bring. If your own identification is the obstacle, say so at the start of the call rather than at the counter; it is a solvable problem, but not one to discover on arrival.

Immigration status is a different question

Identification problems and immigration status get conflated, and they are not the same thing. A California bail bond cannot remove a federal immigration detainer — see immigration holds, which is informational and explains plainly that we do not provide immigration bonds.
