Can You Remove a Co-signer From a Bail Bond?
You signed, and circumstances changed. What the options actually are — and why simply withdrawing is not one of them.
A relationship ends, the defendant stops answering the phone, or you simply realise what you signed. The question is how to get off the bond. The honest answer starts with what you cannot do: a co-signer generally cannot withdraw on their own. The indemnity agreement is a contract, and it runs until the bond ends.
Why it is not a simple withdrawal
The surety put its money behind the defendant partly because you promised to make it whole if the defendant did not appear. Releasing you unilaterally would remove that security while the bond is still outstanding. So any change needs the surety’s agreement, or needs the bond itself to end. See co-signer responsibilities.
The three real options
| Substitute indemnitor | Someone else agrees to take on the obligation, and the surety accepts them. Whether the surety accepts is its decision, based on the substitute’s circumstances. New paperwork is signed; the original co-signer is released only when that is complete. |
| Surrender | Where you believe the defendant will not appear, the surety can return the defendant to custody under Penal Code 1300, releasing the surety — and with it your obligation. Serious for the defendant; the premium is generally not returned. See bond surrender. |
| Exoneration | The bond ends when the court exonerates it, typically at the conclusion of the case. Your obligation ends then, and collateral is returned. See bail exoneration. |
If you are worried the defendant will not appear
Say so early. The worst outcome for a co-signer is a missed court date nobody could prevent: the bond is forfeited, and if the forfeiture is not set aside you are liable for the full bail amount, not the premium. See PC 1305 bail forfeiture and does the co-signer go to court.
Collateral
If you pledged property, that pledge stays in place until the bond is exonerated or you are formally released. See collateral.
