Assault & Battery Bail in Anaheim
The subdivision decides the number. Scheduled Orange County amounts for the assault and battery sections we are called about most, and the rule that changes everything if the case is domestic.
Assault and battery cover an enormous range in California, from a misdemeanour scuffle to a felony carrying six figures of bail. For an Anaheim arrest the person is booked at the Anaheim Detention Facility, and the bail comes from the exact code subdivision on the booking sheet — not from how the incident is described. Two charges a family would describe identically can be $25,000 apart.
Scheduled Orange County amounts, 2026 edition
These are the sections we are called about most. They are illustrative and not a substitute for the schedule itself, and a judge can set more or less at the first appearance.
| Section | Offence | Scheduled bail |
| PC 245(a)(2) | Assault with a firearm | $50,000 |
| PC 245(a)(1) | Assault with a deadly weapon other than a firearm | $25,000 |
| PC 245(a)(4) | Assault by means likely to produce great bodily injury | $25,000 |
| PC 243(d) | Battery with serious bodily injury | $25,000 |
| PC 273.5 | Corporal injury to a spouse, cohabitant or former partner | $50,000 — $100,000 with a qualifying prior within seven years |
Simple assault and simple battery, charged as misdemeanours, sit far below these figures. Full walkthrough: the Orange County bail schedule explained.
Why the subdivision matters so much
Penal Code § 245(a)(1) and § 245(a)(2) would be described the same way by almost anyone who was there — someone was attacked with something. The schedule treats them as a $25,000 charge and a $50,000 charge. Before you raise money, get the section and the subdivision as booked, not a summary of what happened.
The other multipliers:
- Strike priors. One documented strike prior takes bail to $100,000; two take it to $200,000.
- Multiple counts. In Orange County, felony bails do not stack count by count — the highest amount for any one felony offence, plus enhancement, applies. A long complaint does not automatically produce an enormous figure.
- An unlisted section is priced from the state prison top term using the county’s guideline table, which is why two people booked the same night on similar-sounding charges can be quoted very different numbers.
If the case is domestic, the rules change completely
This is the difference that costs families the most time. For specified domestic violence offences — including corporal injury to a spouse, cohabitant or former partner — Penal Code § 1270.1 forbids release on bail at any figure other than the scheduled amount, or on own recognizance, until a hearing has been held in open court.
In practice: the scheduled amount can be posted at three in the morning. Asking a judge for anything lower waits for a court day, with two court days’ written notice to the prosecutor and the defence. That is a statute, not a delay anyone chose. See domestic violence bail, PC 273.5, PC 243(e)(1) and bail reduction hearings.
A protective order is also likely to be issued, and it can bar the person from returning home. Read protective orders and EPOs before anyone drives back to the house.
What to do first
- Get the exact section and subdivision from the detention facility on (714) 765-1988, or let us pull it.
- Ask whether § 1270.1 applies. It changes whether a reduction is even possible tonight.
- Check for priors and warrants, which move the figure more than anything else.
- Arrange the bond so the release is not waiting on paperwork.
Questions we get asked most
How much is bail for assault with a deadly weapon in Orange County?
The 2026 Orange County schedule sets Penal Code § 245(a)(1), assault with a deadly weapon other than a firearm, at $25,000. Assault with a firearm under § 245(a)(2) is $50,000.
Do multiple assault counts multiply the bail?
Not in Orange County. Felony bails do not stack count by count — the highest amount for any one felony offence, plus enhancement, applies.
Why can we not get the bail lowered tonight?
If the charge is a specified domestic violence offence, Penal Code § 1270.1 requires a hearing in open court before release at any figure other than the scheduled amount. The scheduled amount can still be posted immediately.
What does a strike prior do to the amount?
One documented strike prior takes bail to $100,000 and two take it to $200,000 under the Orange County schedule’s enhancement provisions.
