How long someone can be held here

The Anaheim Police Department describes this as a Type 1 jail facility. Under California Code of Regulations, Title 15, section 1006, a Type I facility is defined as a local detention facility used to hold people for not more than 96 hours, excluding holidays, after booking.

That is the regulatory definition of the facility class. It is not a prediction about any individual case, and it is not a countdown. We will not tell you how long a particular person will be held, or where they will go next — those decisions belong to the police department and the court, and anyone who claims otherwise is guessing. If someone is moved, we will find them again.

The Anaheim Detention Facility is a city jail, which means it is a short-stay facility rather than a destination. What happens next depends almost entirely on what the booking sheet says.

• Domestic violence. The charge where the rules genuinely differ. Penal Code § 1270.1 requires a hearing in open court before release on own recognizance or at any figure other than the scheduled amount — so posting the scheduled amount can happen at 3am, while asking a judge to lower it waits for a court day. • DUI arrests, consistently one of the highest-volume bookings at this facility.
• Warrants and failures to appear, where arranging the bond before anyone surrenders is almost always the better sequence.
• Felony and misdemeanor bail, including PC 1275.1 source-of-funds reviews on larger bonds.
• Drug charges.

Watch for the transfer. If a bond is not posted while the person is still here, they are generally moved to county custody through the Intake Release Center in Santa Ana, and from there possibly to Theo Lacy. Once that starts, the release clock effectively restarts. The window while someone is still at the Anaheim facility is the fastest point to act.
